General Terms and Conditions (GTC)

for the Sensoria Online Ticket Shop
Sensoria – House of Fragrances and Flavours, Holzminden

1 Scope of Application

(1) The following General Terms and Conditions (GTC) apply to the use of the online ticket shop of Sensoria – House of Fragrances and Flavours in Holzminden, represented by Stadtmarketing Holzminden GmbH (hereinafter “Provider”), for the purchase of admission tickets and other services offered by Sensoria, insofar as they are booked via the Sensoria online ticket shop at:
https://sensoria.ticketfritz.de/

The Provider does not recognise any terms and conditions of the customer that deviate from these GTC unless the Provider expressly agrees to their validity in writing.

(2) The customer is a consumer insofar as the purpose of the ordered deliveries and services cannot predominantly be attributed to their commercial or self-employed professional activity. An entrepreneur, by contrast, is any natural or legal person or legally capable partnership who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity.

 

2 Conclusion of Contract

(1) The products and services presented in the online ticket shop are non-binding and do not constitute a legally binding offer, but an invitation to place an order.

(2) By confirming the order on the Provider’s website or by placing an order by telephone or in writing via the visitor service, the customer submits an offer to conclude a contract. The Provider accepts the offer by confirmation via e-mail. The booking/order is then binding.

(3) The contract is concluded in German.

 

3 House Rules

By purchasing tickets or other products and services, the customer acknowledges the Provider’s house rules as binding.

 

4 Prices

(1) All prices stated on the Provider’s website include the applicable statutory VAT unless expressly stated otherwise.

(2) Any shipping costs incurred will be shown to the customer in the order form and shall be borne by the customer unless the customer makes use of their right of withdrawal.

(3) In the event of withdrawal, the customer shall bear the direct costs of reimbursement.

 

5 Payment

(1) Payments may only be made by credit card (Visa and MasterCard).

(2) Payment of the purchase price is due immediately upon conclusion of the contract.

(3) Until full payment has been made, the tickets and other services remain the property of the Provider.

(4) If a payment is charged back, the Provider is entitled to immediate return of the ordered tickets or may withdraw from the contract and block the tickets or the barcode sent. The customer shall compensate the Provider for any damage resulting from the chargeback.

(5) Payment processing is carried out by First Cash Solution GmbH, acting as representative and on behalf of Sensoria – House of Fragrances and Flavours, Stadtmarketing Holzminden GmbH.

 

6 Delivery

(1) Tickets are delivered via the “Print@Home” procedure: Immediately after conclusion of the purchase contract, the tickets, which are equipped with a barcode, are sent by e-mail as a PDF attachment and must be printed by the customer or saved on their smartphone. Goods are shipped by post. The Provider bears the shipping risk if the customer is a consumer.

(2) If the customer has not received the e-mail containing the ticket within 24 hours after booking, they are obliged to inform the Provider immediately. The same applies if a faulty PDF file or faulty tickets are received. Tickets must be checked for correctness with regard to quantity, prices, date, time, event and location. Failure to do so excludes claims due to loss of tickets or other complaints.

 

7 Validity and Instructions for Use

(1) Tickets printed by the visitor using the Print@Home procedure or saved on a smartphone become valid only after full payment.

Open-dated admission tickets

(a) The open-dated admission tickets offered in the online shop entitle the holder to a single entry during the venue’s regular opening hours. The ticket is not tied to a specific date of visit.

(b) The ticket is valid for a period of one year from the date of purchase. After the expiry of this validity period, the ticket becomes void; there is no entitlement to redemption or refund thereafter.

(c) The ticket is valid for standard admission only and does not automatically entitle the holder to attend special events, special exhibitions or fee-based additional services, unless these are expressly included in the scope of services.

(d) Redemption of the ticket is subject to the applicable house rules and, for organisational reasons, may be subject to capacity restrictions.


(2) Admission is subject to the Provider’s opening hours or the dates stated on the tickets. The opening hours are determined by the Provider.

Deviating opening hours will be published on the Provider’s website and must be checked by the customer prior to the visit. The Provider does not provide compensation for closures due to private or other events.

(3) Tickets must be checked for correctness with regard to quantity, prices, date, time, event and location – see Section 6 (2).

(4) The one-time barcode on the ticket will be invalidated by the Provider using barcode scanners. Multiple use by duplicating the barcode is excluded.

(5) Discounts: The customer is responsible for checking whether they meet the personal requirements for any discounts offered. The requirements for claiming a discount must be met on the day of the exhibition visit. The customer must provide proof of eligibility by presenting a photo ID at the admission control. Otherwise, the difference to the full ticket price must be paid before entry at the ticket desks of the exhibition venue.

(6) The customer is obliged to keep the online ticket in a safe place like cash or conventional tickets and to protect it against misuse. The Provider assumes no responsibility for loss and/or misuse of the ticket and provides no replacement.

(7) It is prohibited to print a Print@Home ticket multiple times or otherwise duplicate it for the purpose of misuse. Misuse results in forfeiture of the right of admission without compensation and the ticket becomes invalid. In addition, the Provider reserves the right to claim damages and to file criminal charges.

(8) Commercial resale to third parties is expressly prohibited.

 

8 Warranty for Defects and Guarantee

(1) The Provider is liable for defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code (BGB). Towards companies, the warranty period for items supplied by the Provider is 12 months.

(2) An additional guarantee exists for tickets and other services supplied by the Provider only if expressly stated in the order confirmation for the respective item.

 

9 Liability

(1) Claims of the customer for damages are excluded. Exempt from this are claims for damages arising from injury to life, body or health, or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages based on an intentional or grossly negligent breach of duty by the Provider, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract.

(2) In the event of a breach of essential contractual obligations, the Provider shall only be liable for the typical, foreseeable damage if caused by simple negligence, unless the customer’s claims for damages relate to injury to life, body or health.

(3) The limitations of liability in paragraphs (1) and (2) also apply in favour of the legal representatives and vicarious agents if claims are asserted directly against them.

(4) The Provider is entitled to refuse admission in cases of overcrowding or for other safety reasons, or to terminate the visit prematurely. Individual areas of the exhibition venue may be closed for structural or organisational reasons. Claims for damages are excluded in these cases.

(5) The provisions of the German Product Liability Act remain unaffected.

 

10 Right of Withdrawal

There is no right of withdrawal for contracts for the provision of services related to leisure activities if the contract provides for a specific date or period for the provision of the service. Therefore, when selling tickets for a fixed date or period, you do not have a right of withdrawal. Every ticket order is therefore binding and obliges you to pay for the ordered admission tickets.

 

11 Cancellation

There is no entitlement to exchange, return or partial refund for paid tickets.

 

12 Final Provisions

(1) The laws of the Federal Republic of Germany shall apply to contracts between the Provider and the customer, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory provisions, in particular those of the state in which the customer as a consumer has their habitual residence, remain unaffected.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Provider and the customer shall be the Provider’s registered office.

(3) The contract shall remain binding in its remaining parts even if individual provisions are legally invalid. The statutory provisions shall apply in place of the invalid provisions, insofar as such provisions exist. If this would constitute an unreasonable hardship for a contracting party, the contract shall become invalid as a whole.

 

 

 

Annex 1 – Terms and Conditions of Participation for Events

Preamble

These terms and conditions of participation apply to all events organised by Stadtmarketing Holzminden GmbH within the area of Sensoria – House of Fragrances and Flavours, Holzminden. Events include, among others, workshops, tastings, lectures and special events.

 

1 Registration and Conclusion of Contract

(1) Bookings for participation in events can be made via the online shop or in person on site.
(2) Registrations are generally considered in the order in which they are received and are only possible until the respective registration deadline. The number of participants is limited.
(3) A contract is only concluded after written order confirmation by Stadtmarketing Holzminden GmbH.

 

2 Due Date and Payment

(1) The participation fee is due immediately and without deduction upon conclusion of the contract.
(2) Participation is only possible if payment is received in time.

 

3 Withdrawal by Participants

(1) Participants may withdraw from the contract for seminars up to eight days before the start of the event without stating reasons. Payments already made will be refunded in full in this case.

(2) In the event of later withdrawal or non-attendance, the full participation fee shall be due.
(3) Withdrawal must be declared in writing or in text form; the decisive factor is the time of receipt by Stadtmarketing Holzminden GmbH.
(4) If the participant provides a substitute person with the consent of Stadtmarketing Holzminden GmbH, the payment obligation shall cease. Consent may be refused if the substitute participant does not meet the stated age requirements of the event.

 

4 Right of Withdrawal

The events of Stadtmarketing Holzminden GmbH constitute contracts for the provision of services related to leisure activities which provide for a specific date or period for the provision of the service. Consumers therefore have no right of withdrawal for these contracts.
Legal basis: Section 312g (2) sentence 1 no. 9 German Civil Code (BGB).

 

5 Cancellation of Events

(1) Stadtmarketing Holzminden GmbH reserves the right to cancel events in cases of force majeure or if the number of participants is insufficient. Participants will be informed immediately by telephone or e-mail.
(2) Fees already paid will be refunded in full in this case.
(3) Further claims for damages exist only if Stadtmarketing Holzminden GmbH acted intentionally or with gross negligence.

 

6 Changes to the Event Schedule

Changes to the schedule or replacement of lecturers/instructors are reserved, provided that they do not significantly impair the character and purpose of the event. Such changes do not entitle participants to withdraw or reduce the fee.

 

7 Liability

(1) Stadtmarketing Holzminden GmbH shall be liable without limitation for damages arising from injury to life, body or health.
(2) Otherwise, it shall only be liable in cases of intent or gross negligence.
(3) Liability for damages arising from the breach of an essential contractual obligation shall be governed by the statutory provisions. In this case, liability of Stadtmarketing Holzminden GmbH shall be limited to compensation for the foreseeable damage typically occurring.

 

8 Copyright

All working materials handed out or made available digitally in the context of events are protected by copyright. Reproduction, distribution or forwarding to third parties is only permitted with the prior written consent of the copyright holder.

 

9 Data Protection

(1) Personal data of participants is processed exclusively for the purpose of organising and conducting the event. Processing is carried out in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

10 Place of Performance and Jurisdiction

(1) The place of performance for all services is Holzminden.
(2) Note for consumers: For consumers, the statutory place of jurisdiction at the place of residence applies.
(3) A fixed place of jurisdiction applies only to merchants, legal entities under public law or special funds under public law. In these cases, the place of jurisdiction is Hildesheim.

 

11 Additional Agreements

Additional agreements, amendments or supplements to these terms and conditions of participation must be made in writing.

 

12 Severability Clause

Should individual provisions of these terms and conditions of participation be wholly or partially invalid or become invalid, the validity of the remaining provisions shall remain unaffected.
